Assault & Utter Threats

An assault is any touching done without consent. It can be as minor as an unwanted clap on the back or as major as a punch to the face. An assault can even be committed without actual touching where a person threatens by act or gesture to apply force, for example by shaking a fist.

A “simple” or “common” assault is an assault without an additional elements. There are a number of more aggravated forms of assault such as assault causing bodily harm, assault with a weapon, assault by choking and aggravated assault. These other types of assault require proof of additional elements, for example that the unconsented touching caused bodily harm.

Unlike assault, which requires some form of physical component, the offence of uttering a threat is one that is committed by words. The offence will be made out when a person communicates a threat to cause death or bodily with the intention that their words be taken seriously or for the purpose of intimidating the recipient. The recipient of the threat does not have to take it seriously, indeed they don’t even need to be aware of it.
