When an accused is held for bail, they need a plan to present to the court to demonstrate how the risks associated with the charges can be controlled in the community. Sometimes this includes a surety – a person who offers to supervise the accused in the community and to enforce the rules put in place by the court, promising and/or depositing a sum of money with the court to promote the accused’s compliance. As the eyes and ears of the court in the community, the surety must come up with a plan to explain to the court how they will do their job. The plan will outline things like, where the accused will live, how communication with alleged victims or witnesses will be prevented, whether they will be permitted to be outside of the home or on house arrest, how to make sure they won’t have access to contraband items like firearms or drugs, and making sure they appear in court.
