Dangerous Driving
Dangerous driving is a criminal offence that captures driving that is objectively dangerous in the light of all of the circumstances. Unlike the Highway Traffic offence of careless driving, which requires only a lack of due care or attention, dangerous driving sets a higher threshold. The driving must constitute a marked and substantial departure from a reasonable person in the circumstances. Examples of behaviour that may amount to dangerous driving include, extreme speed, racing, impairment, and falling asleep at the wheel.
Penalties for dangerous driving range from fines to jail time and come with an automatic driver’s licence suspension for a year or more under the Highway Traffic Act, if not a court-ordered prohibition. Where bodily harm or death is caused, jail sentences are the norm.
