Theft is one of the most commonly charged property-related offences. In general, it refers to the taking of something that belongs to another party without the right to do so. Like many offences, theft can cover a wide variety of conduct. It may involve the taking of an object, for example shoplifting. It may also involve the taking of something less tangible, like hydro or gas. Obtaining or possessing someone else’s identity with the intention of using it to commit an indictable offence, is another form of theft known as identity theft. The Criminal Code also makes the theft of a motor vehicle a stand-alone offence, with increasingly serious penalties where violence is used or for repeat offenders.

Not only is it an offence to commit a theft, it is an offence to be in possession of stolen property. Possessing the tools used to commit a theft – such as break and enter tools, electronic devices to steal cars, or bank or credit cards belonging to someone else, may also constitute separate offences.
