In Canada the possession of firearms and other prohibited or restricted weapons is highly regulated. Possessing a firearm is a privilege, not a right. It is illegal to possess a firearm without a licence to do so, and penalties can be significant.
Firearm offence range from the criminalization of failing to comply with regulations or safe practices for storage, transport and use, to the unlawful possession of restricted or prohibited firearms loaded or with readily accessible ammunition.
Firearms are not the only weapons that form the basis of offences in the Criminal Code. A “weapon” is not just something designed to be used as a weapon, like a knife. At law, an object becomes a weapon when it is used to cause death or injury or to threaten or intimidate. Even a harmless object, like a pillow, can become a weapon if it is used as one.
The law regarding “weapons” is not always obvious. Carrying a weapon for a purpose dangerous to the public peace is another common weapons offence. A dangerous purpose can include pro-actively carrying a weapon for self-defence. Prohibited weapons include items that may be readily available for purchase at retail stores, such as certain knives or “bear spray”. It is important to understand that the ease with which these items are available is not indicative of their lawfulness.
