Fraud is an offence that is similar to theft. However, it does not require that property actually be taken. The offence is committed whereby deceit, falsehood or other fraudulent means, the property of another party is put at risk.

Fraud can take on many forms, from obtaining government benefits by lying about income, to using one’s position to misappropriate funds, to using funds borrowed under one pretense for another purpose, and many more. It is often accompanied by other offences, such as uttering forged documents.

The Criminal Code provides a list of circumstances that increase the applicable sentence. These include the magnitude, duration and complexity of the fraud, number of victims and impact on them, being in or abusing a position of trust, or engaging in additional deceptive behaviour to conceal the fraud.

Many fraud investigations are begun by parties other than the police, such as employers, insurers or government agencies.
